Pool Closure Due to COVID

Posted By on August 5, 2020

The pool itself is not a safety risk for swimmers, since there is no evidence that the coronavirus can spread to people through water. The biggest safety concern is whether people can maintain a distance of at least 6 feet from one another, both in and out of the pool.  Staff would have to be hired to ensure the rule is followed.  Additionally since the spa would have to be closed it poses another challenge as the spa is in the same area as the pool.

There is a potential liability concern that the association’s insurance would not provide coverage if a claim were to be filed.  This would result in the association (all the homeowners) paying for the cost to cover the claim by way of special assessment. The financial impact of a potential legal battle is unknown.

Although the pool is not being used the requirement to maintain the pool still exist and the pool vendor has to be paid for this service.

The Board of Directors have a fiduciary responsibility and when making a decision they have to make decision in the best interest of the entire membership. To help eliminate potential liability claims with the unknown potential cost, the additional cost to the membership for added services and the increased numbers of infections

the pools will remain CLOSED and the situation will be monitored.
